In a personal injury suit, how can I keep my portion from being eaten up by attorney "expenses"? I received a contract from a personal injury attorney. It states that he will receive 40%, and that expenses (even his) will come out of my portion. There's no cap on his "expenses" so how can I protect my 60% from being eaten up? I see no point in wasting time pursuing a case that gains me little or nothing. BTW this is about the Jif Peanut Butter/Salmonella thing, which I assume will be a class action suite. Can I request a contract stating the limit of expenses? And if they say no.....run the other way! Great answers! And to clarify Stay_Fan1: I will not know if I or my children contracted Salmonella or not until our jar of peanut butter is tested. I do know that I was sick for an entire month (after not being ill for 3 years). I do know that 2 of my son's were also sick during same time period. Might be coincidence, might be salmonella. The attorney is paying for testing of the P butter. If it's clear, then no case. If it's not, then I don't feel guilty about pursuing legal action. A company as big as Con Agra should have stringent quality control and batch testing. If they didn't, shame on them!
Does anybody know a good personal injury attorney? I have talked to several with no satisfaction. My situation is thus: Last week I inadvertantly nailed my foot to the floor with, what I thought, was a quality nail gun. After running in circles for aboout an hour, I became dizzy and rammed my head into the doorframe. Thanks to the Para- Medics, I was rescued from what could have been a much more serious fate. Anyway, all of the attorneys I have talked to say I can't sue myself for negligence. Why not? I have a lot of money. Why can't I get some?
Personal Injury Attorney - Income and Getting Clients? 1. How many clients would a 1st of 2nd year Personal Injury ("P.I") Attorney expect to handle annually? 2. How does a P.I Attorney build a practice and obtain clients? (aside from the TV Commercial type adverts) 3. This question is for practicing P.I Attorney's - i assume job satisfaction is very high give you are helping people fight high powered insurance companies and the like, is this true?
Firing a Personal Injury Attorney? This case is from an auto accident in August '06. This attorney has been aggravating since I hired him. He's terrible to get ahold of, hasn't done his job...I could go into detail. But my question is this...I have now been offered a settlement by the insurance company that will not cover bills acquired. I asked the attorny initially what his demand was, he said he didn't have one that the insurance company would make the offer. Anyhow, he never filed for lost wages like he was supposed to, I found that out too late. Now after a week of calling and requesting info, he will NOT call me back!!!!! If I fire him now, what will I owe him? How can I fire him? I'm going to try to get a consult with another attorney, but at this point I'm totally disgusted and refuse to pay this moron for what he DIDN'T do for me. He left us responsible for gathering all paperwork, etc, for him and faxing it through too...still wants his 33%.
Statue of limitations for Personal Injury, an attorney filed a complaint for me in my county? which is in Southern California on my behalf back in 2003 for personal injury against the City County and Sheriffs Department of that county. The reason was due to an injury I sustained while being arrested, my hand became numb due to a handcuff injury (handcuffs were placed on to tight, I even have a scar), I saw two orthopedic doctors and all one did was take xrays and said he found no permanent damage, the other said he concurred with the first. The lawyer could not do anything because the doctors supposedly found nothing, so I left it at that. I however continue to suffer from a numb hand, its my right hand, there is also weakness when I try to carry something heavy or try making a fist. I really think the doctors lied and didnt want to get involved because it was a suit against the local police and city and county. I think I made a mistake and should have seeked a lawyer and doctor from out of town. My question is this, I know there is a 2 years statute of limitations for filing a suit, does this apply to doing anything at all? reason is I did file a complaint withing the right time, however nothing came about it, can I reopen the case or have another attorney take over since it was never closed? shorty, take it from me, it was due to the handcuffs ok. thanks though
Is getting an attorney for a personal injury claim worth it? I got in an accident riding passenger in a car, it got totaled and I have 3 bulging discs in my back, granted I am 19 years old and my ATV riding is over with, also I can't have any kind of labor job due to the discs in my back, the insurance company is offering me $10,000 but my unpaid hospitol bills will take half of that. I just need some advice on where to go from here and what would be best.
i need to know if i qualify for a personal injury attorney? i was hired in a diff dept at wk 1 yr ago, they added a diff task to my job descript and i consenquently got injured. almost 9 mo.s later, still hurt (alot) still under wks comp, still no actually dx, Doc said on Thurs that he believes my shoulder is now "Frozen". may need maj surgery. Can i sue for neligence, for not having others share responsibility? (They have same job title as I do)? Also where do I go for an Attorney who works on Consignment? Thank You. i got injur last july, after 1 yr on new job assign, now i've been there 18 mo. let me add more details. i'm a clerk in a maj hosp. one of three. the extra task was to stock beside proc carts. there are 10. on wheels, but very heavy. other two clerks refused, since i wanted the tras very bad i agreed not thinking it would be very hard to do. each shift i was then req to do all ten, as well as my other duties (same as other 2 crks). i felt alot of pressure from Staff, and neg feedback if I didn't get them finished in a timely manner, even when we had alot of admits. i feel this should have been a shared duty, maybe then i wouldn't have gotten hurt. i also feel that my position should't have been altered unless it was changed for ALL clerks, present and future. Also workers comp was denied, then picked up/still haven't gotten the right dx. have had six dx so far. thanks.
Personal injury attorneys: Good, bad, or indifferent? These lawyers claim to be good hearted individuals who are only interested in pursuing justice. To prove their commitment, they are willing to work for free until a favorable settlement is achieved. What cash poor accident victim could refuse such a noble proposition? Please consider: Nobody works for free. These lawyers are able to cherry pick their cases based upon how lucrative their practices are. No competent lawyer will accept a personal injury case unless they are sure of a settlement. Also consider that the lawyer will typically receive 60% of the settlement plus their expenses (taken off of the top). The kindly lawyer will end up receiving upwards of 70% of the settlement, leaving a miserable ~30% for the person who actually was injured (talk about adding insult to injury). If you doubt me, then just try to hire a personal injury attorney on a hourly basis. They make so much more by working on "CONTINGENCY" that you won't have any takers. Gunny T: You are incorrect. I am making no assumptions regarding juries, judges or attorneys in general. I am specificly questioning the motives and manner in which PERSONAL INJURY attorneys operate. Sounds to me like you are making some assumptions yourself. 1) Are you absolutely positive that the plantiff's attny was working pro bono vs on contingency? 2) How do you know that the jury voted against a just decision in order to watch television? It sounds to me as if you are a little biased as to your specific case. Perhaps you were the plantiff?
Personal Injury Attorneys and Ambulance Chasing? I use to work for a personal injury law firm. One of the attorneys took exception to the term "ambulance chaser." "It's not fair to call us ambulance chasers," he told me, "afterall, we usually get there before the ambulance."
Personal injury compensation? How much could one reasonably expect to receive in compensation for a fractured pelvis injury sustained in a motorcycle accident, where the car driver who hit the motorcyclist was at fault? It probably depends on how aggressive the personal injury attorney is, but what would be a ball park figure, for the injury component and not relating to the damage to the motorcycle?
